You may use ToxSoap only if you can legally form a binding contract where you live. ToxSoap is intended for **professional/clinical users** and is **not directed to children**.
2. Nature of the Service (Important)
ToxSoap helps users generate a structured **medical toxicology SOAP note** based on information the user enters. **The Service is for documentation support and informational/educational purposes only.** It does **not** provide medical advice, diagnosis, treatment, or patient-specific clinical decision-making. ### Not for emergencies Do **not** use ToxSoap for emergency response. If this is an emergency, contact local emergency services and/or your local poison center immediately. ### No professional relationship Using the Service does **not** create a physician–patient relationship, consultant–client relationship, or any other professional relationship with Medical Toxicology LLC.
3. Your responsibilities
You agree that you are solely responsible for: - **Clinical judgment and verification:** reviewing and validating any output before using it in any clinical or professional context. - **Accuracy of inputs:** ensuring the information you enter is accurate, lawful, and appropriate. - **Compliance:** using the Service in compliance with applicable laws, regulations, and institutional policies (including any healthcare privacy/security rules that apply to you). ### Do not enter unnecessary identifiers The Service may prompt for information such as caller details, facility details, and patient demographics. **You should avoid entering direct patient identifiers unless you have determined it is necessary and you have the right/legal basis to do so.**
4. Data handling and privacy
Our handling of information is described in our **Privacy Policy** (available on our website). In summary: - The Service is designed so that information entered into the form is used to generate the output you request and is **not saved to our database** as part of normal operation. - Limited technical data (such as server/security logs) may be processed to operate and secure the Service.
5. Acceptable use
You agree not to: - use the Service for any unlawful, harmful, or abusive purpose - enter data you do not have the right to share (including confidential information where you lack authorization) - attempt to probe, scan, or test the vulnerability of the Service or bypass security measures - reverse engineer, decompile, disassemble, or otherwise attempt to extract source code (except where such restriction is prohibited by law) - interfere with or disrupt the Service (including by introducing malware or excessive automated requests) - use the Service to create or distribute content that is fraudulent, misleading, or dangerous We may limit, suspend, or terminate access if we believe you are violating these Terms or creating risk to users or the Service.
6. Intellectual property
The Service, including its design, text, templates, software, and trademarks, is owned by Medical Toxicology LLC or its licensors and is protected by applicable intellectual property laws. ### Limited license We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal, lawful purposes in accordance with these Terms. You may not copy, sell, sublicense, or commercially exploit the Service (or any part of it) except as expressly permitted by us in writing. ### Feedback If you provide suggestions or feedback, you grant us permission to use it without restriction or compensation.

The Service may include links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices.

We may modify, update, restrict, or discontinue the Service (in whole or in part) at any time, including to: - improve functionality - maintain security - comply with legal requirements We do not guarantee the Service will always be available or error-free.
9. Disclaimers
**THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."** To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Outputs may contain errors, omissions, or inconsistencies. **You are responsible for reviewing and confirming all outputs before use.**
10. Limitation of liability
To the maximum extent permitted by law, Medical Toxicology LLC and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability for claims relating to the Service will be limited to the amount you paid to use the Service in the **12 months** before the event giving rise to the claim (or **USD $100** if you paid nothing), unless applicable law requires otherwise.
11. Indemnification
You agree to defend, indemnify, and hold harmless Medical Toxicology LLC from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: - your use of the Service - your violation of these Terms - your violation of any law or third-party right - your use, storage, or disclosure of any output or data generated through the Service
12. Governing law and disputes
These Terms are governed by the laws of the **State of Arizona, USA**, without regard to conflict-of-law principles. Unless prohibited by applicable law, any dispute arising from these Terms or the Service will be brought in the state or federal courts located in **Arizona**, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website and update the "Last updated" date above. Your continued use of the Service after changes become effective means you accept the updated Terms.
